Game rules
§1 Important vocabulary:
1) ToM: abbreviation for the name of the game, Tales of Magic.
2) Account: a player's virtual wizard character in the game ToM. An account consists of a character name, a password and an account ID, among other things.
3) Character name / player name / username / nickname: a nickname that the player chooses wizard/witch character in the game ToM; the username is also used to log in to the account.
4) Password: the individual password for each account, which can be used by the game administrators to log in to the account.
5) Account ID / User ID: unique identification number for each account that can be found at the end of "your link" on the main character page in the game.
6) Recruitment link: a link associated with each account and containing the unique User ID for that account; if someone clicks on a link he / she will automatically be invited to play the game. The recruit link is located on the main character page in the game.
7) Server / Game world: a separate ToM world; if a language version of ToM has more than one server / Game world, each account on that server is assigned to that server and cannot be used on or transferred to another server.
8) Gold: the main virtual currency unit in the game.
9) Gemstones / Gems / Jewels: the "Premium" virtual currency unit in ToM; some additional features in the game (as well as Premium membership) are available only with gems. Gems can be obtained in the game itself from the publisher of ToM, the RedMoon Studios GmbH & Co. KG (RMS), or by participating in promotions and contests advertised on the official Game Boards.
10) Game administrator: a person authorised by the game operator (RedMoon Studios) to enforce the Rules and Terms of Service outlined on this page and to provide technical assistance/support for the players.
11) Player: the person using a Tales of Magic game account.
12) Circle / coven / clan / guild: user-created organisations within the game that allow players to gather, cooperate and perform group duels. A coven consists of at least one wizard, called its founder or owner.
§2 Accounts in the game are owned by the RedMoonStudios GmbH & Co. KG. Players have no legal claim to registered game accounts or any of their contents. This also applies to any unused gems in the game accounts. Players have the right to use one account on each server, for an indeterminate period, in accordance with the Rules.
§3 The sale of game accounts and/or any other game contents is strictly forbidden and may lead to deletion of any game accounts involved. Attempts to sell any time and/or money invested in the game account(s) will be treated as an attempt to sell the account and will also result in account deletion. The same applies retroactively to any accounts that were clearly sold in violation of the Terms of Service;.
§4 The help page of the game contains a link to the official forum/board for ToM. All information regarding organisational issues, updates and upcoming changes announced in the forum by RMS administrators are valid in the same manner as information announced directly in the game. Players must check the game board occasionally to keep themselves informed of any changes or important issues.
§5 Players are required to comply with any requests issued by RMS employees or their agents, including the official game administrators. Failure to comply with reasonable administrative requests may result in a three (3) day account suspension.
§6 The game administration can be contacted in the game board (post your inquiry in the support subforum or send a private message to the administrator).
§7 Upon reasonable grounds, administrators have the right to:
- access a player's account to inspect it for suspected rule violations
- block (suspend) or delete a player account if the administrator has determined that a violation of the rules has taken place for which account deletion is foreseen
- censor/edit a player or coven profile or the name of a familiar if it contains inappropriate content
§8 The player has the right to appeal any administrative action by placing a post in the appropriate section of the official game board or by directly contacting the game administrator involved. If the dispute can not be resolved in the game board, the player has the right to submit a complaint about the administrator by sending an e-mail (in English or German) to: support@redmoonstudios.de – please provide your account name, user ID, server number and a detailed description of the grounds for your complaint.
§9 Game administrators will NEVER contact a player in the game or game board asking for the game account password. Any person asking for such data is not an administrator and is trying to steal your account, and his or her username should immediately be reported to the support team.
§10 All game bugs (any errors in program / game code of ToM) must be immediately reported to the game administrators. Intentional use of bugs to gain benefits from them may lead to modification, suspension or deletion of any game accounts involved.
§11 The use of multiple accounts (actively using more than one game account on the same server) and any other forms of cheating that involve the use of more than one game account (farming, pushing etc.) may lead to account suspension or deletion without warning. Farming / pushing refers to individual or coven duels that involve the use of more than one account being controlled either by the same person or by other players who are communicating with the other participant(s) to plan and organise the actions being carried out so the actions lead to advantages in the game (gold, experience points, victories etc.) for one or more of the involved accounts and/or their covens. Any game accounts clearly involved in farming /pushing are subject to deletion without warning with no exceptions, whether the accounts are being attacked or attacking other accounts. Players being attacked by other accounts that are losing gold/experience on a regular basis are expected to inform the administration about the attacks, as this may be an attempt to make it appear that your account is involved in farming. This rule also applies to the creation of new covens containing multiple accounts that serve as a target for coven duels and only serve to enrich other covens. If it is found that covens are involved in the use of "coven farms", the coven admins will be asked to explain the situation. If the coven admins cannot explain the matter, the coven admin accounts will be subject to a 14 day suspension and any covens involved will be deleted with no exceptions. It is important to note that frequent attacks on accounts or covens with gold is NOT farming as long as no communication or arrangement is taking place and no type of control over the covens/accounts being attacked is involved. Additionally, frequent attacks on other players is not considered harassment under the game rules, as attacking other players is a key element of the game!
§12 Each account is checked on the assumption that is used by the person, who registered the account or received them from other players and runs in a manner consistent with the Rules. We are emphasizing here that the mutual assistance in running their accounts by logging to someone else's account is not allowed, and if one player wants to help in carrying out certain actions on another player's account then can be used the remote function of Account sitting.
§13 Players who share a computer and/or IP address should report the situation to the game administration. When doing so, it is important to provide the user ID / links to all accounts (see Account ID above.
§14 It is strictly forbidden to use scripts, bots and similar programmes of any type that automate actions in the game and/or automatically read data from the game server. The use of any type of script or programme to gain benefits in the game will result in deletion of any accounts involved with no warning. The aforementioned benefits are for example fast advancement in the Hall of Fame, quickly gaining experience points and/or gold etc. This rule also applies to any browser functions or browser plugins/addons that are capable of automating game play or data collection from the game server in any manner, the use of link exchange sites and all internet services that enable you to collect "clicks" on your recruit link without any direct action by a human being. Players may use data processing software or scripts that use MANUALLY collected game data. As long as the data is not being automatically collected via a script/bot/tool, any game data available may be further processed in any manner once it has been obtained manually from the game.
§15 Any distribution of tools, scripts or bots which do not comply with the above rules (see §14) is prohibited and may lead to immediate account deletion at the admin's discretion.
§16 The accounts of players who log into the account of another player without their permission may be suspended or deleted. Theft and/or deletion of covens after a merger (fusion) with another coven or unauthorised access to accounts belonging to other players will lead to account deletion of the player responsible.
§17 Deleted accounts can be restored to the game by the Administration. Only a player to whom this account belonged can ask for it and only in cases where it has not been deleted for breaking the rules of the game. When addressing the administrator with the request for the restoration of your account, please provide the server name, nickname and e-mail address assigned to your account at the time when the account was deleted, aswell as the email adress used for registration, if different. The maximum period of time in which the account can be restored is 30 days and account restoration requests are accepted up to 21 days from the date of the deleting or blockade of the account.
§18 The accounts of players who use offensive, pornographic, politically radical, racist, Nazi or illegal content in the player's name, familiar's name or in the character description may be blocked for a period of 14 days; in extreme cases the account may be deleted outright. If coven names or descriptions etc. are involved, the responsibility for the contents of the coven description falls upon the players who have the privileges to edit the coven's data.
§19 Player and coven descriptions may not contain any content that could cause confusion for other players by leading them to believe that the coven or player has any type of special privileges or status and resulting in any type of advantage for the player/coven due to the description contents. For covens, responsibility for the contents of the coven description falls upon the players who have the privileges to edit the coven's data. The game administrators can edit or request changes to any account/coven description or remove them completely if they feel it is necessary. If a violation of this rule is established, the account owner / coven elders will be warned by the administrator. In extreme cases, the account or accounts will be blocked for a period of 7 days. Impersonation of game administrators or RedMoon Studios employees and/or "password phishing" will be punished with account deletion with no warning.
§20 Player names and battle reports may be posted in the description of the coven or character, but must be removed immediately if requested by the players who appear in the reports. Using this information in an insulting manner is prohibited. If a player does not remove such reports or content in spite of your polite and reasonable requests, you can ask for help from the game administrators. If a player does not remove them despite instructions from the game administrator, the player's account will be blocked for 3 days and the description removed.
§21 It is forbidden to insult other players in personal messages in-game or in the game forum. The accounts of players who insult other players or members of the game administration team may be blocked for a period of 7 or 14 days, depending on the content of the message. Accounts of players sending messages containing violent, pornographic, politically extremist, illegal, racist, sexist or otherwise inappropriate content may be blocked for a period of 14 days. Extreme cases involving threats of violence etc. may result in immediate account deletion.
§22 Spamming, flooding, deliberate provocation and harassment of other players through messages in-game is forbidden. "Spam" is defined as unsolicited, unwanted or unnecessary messages or any type of third-party advertising (spamming - sending spam) and flooding is repeatedly sending the same message or many messages in a very short time intervals. This situation also applies to messages sent on behalf of a coven or addressed to a coven, as well as submission of multiple coven applications to the same coven by a player. The official forum (official board) contains sections created to allow players to advertise for their coven or character. Violation of this rule will result in a warning. Repeated violation may lead the game administration to suspend the account for at least 7 days. Commercial solicitation is strictly forbidden and will lead to deletion of any game accounts involved!
§23 The player is responsible for the propagation of his/her recruit link. The game operator and their agents are not responsible for any consequences resulting from improper placement of the link on public chat rooms, message boards, or guest books if the player violates the terms of service regarding recruit/thief links. Recruit links on Tales of Magic game forums or placed in the player/coven profile must be clearly recognisable as a recruit link and the recipient must be able to choose whether she/he actually wants to click the link. The use of i-frames, short links or scripts to hide links is forbidden; the actual address of the link should be visible if the mouse is moved over the link.
§24 Acting as a mercenary in the game is forbidden. A mercenary is a player who attacks other players after receiving requests/orders by other players who are willing to pay the player for attacks on others, i.e. the player attacks other players in exchange for gold/jewels. This rule applies both to individual players and covens. Violation of this rule will result in warnings for both the player(s) offering the mercenary services as well as the players who are requesting them. Repeat violations of this rule will lead to a seven (7) day account suspension by the game administrators. In the case of covens hiring mercenaries, the players possessing with rights to carry out attacks will be held responsible.
